Skyline Experiences LLC, DBA Skyline Pickleball
Assumption of Risk, Waiver, and Release of Liability
By registering for and participating in any Skyline Pickleball activity, including but not limited to leagues, tournaments, events, open play, social gatherings, or related activities (collectively, the “Activities”), you agree to the following:
1. Assumption of Risk
I understand that participating in pickleball and related Activities involves inherent risks, including but not limited to physical injury, falls, collisions with other participants, equipment-related injuries, overexertion, illness, permanent disability, and death.
I acknowledge that these risks may arise from my own actions or inactions, the actions or behavior of other participants, the condition of the playing surface, equipment, or facilities, weather or environmental conditions, and the nature and pace of the sport itself.
I voluntarily assume all known and unknown risks associated with participation.
2. Release of Liability
To the fullest extent permitted by law, I release and discharge Skyline Pickleball, Skyline Experiences LLC, and their respective owners, officers, employees, contractors, partners, sponsors, affiliates, and agents (collectively, the “Released Parties”) from any and all claims, liabilities, damages, or causes of action arising out of or related to my participation in the Activities.
This includes claims arising from ordinary negligence, but does not include gross negligence or willful misconduct where prohibited by law.
3. Medical Acknowledgment
I certify that I am physically able to participate and have not been advised otherwise by a medical professional.
I understand that Skyline Pickleball does not provide medical insurance or medical services. I assume full responsibility for any injuries or medical conditions that may arise.
In the event of an emergency, I authorize Skyline Pickleball to seek medical treatment on my behalf if I am unable to do so.
4. Alcohol and Substance Use
I understand that some Activities may involve environments where alcohol is present.
I acknowledge that consuming alcohol or other substances may impair my judgment and increase the risk of injury. I agree that I am solely responsible for my participation while under the influence of any substance.
Skyline Pickleball reserves the right to remove any participant from an Activity without refund if their behavior, including intoxication, is deemed unsafe or disruptive.
5. Code of Conduct and Removal
I agree to treat all participants, staff, and venue personnel with respect, follow all rules, instructions, and safety guidelines, and refrain from unsafe, aggressive, harassing, or disruptive behavior.
I understand that Skyline Pickleball reserves the right to remove me from any Activity, without refund, if my behavior violates these expectations or compromises the safety or experience of others.
6. League Policies: Divisions, Participation, and Refunds
I understand and agree that I am responsible for registering in the correct skill division.
Skyline Pickleball may remove or reassign players who are not appropriately placed. If a division is full, I may not be able to switch divisions. Players registered in the wrong division may be removed without refund.
All registrations are final. No refunds will be issued for scheduling conflicts, failure to attend, incorrect division selection, or removal due to violation of rules or conduct.
Skyline Pickleball reserves the right to modify league format, schedules, locations, or structure as needed.
7. Third-Party Venues
I understand that Skyline Pickleball may host Activities at third-party facilities, including but not limited to Pickletown and PIKL LA.
I acknowledge that these venues are independently owned and operated, Skyline Pickleball does not control the condition or management of these facilities, and I may be required to complete additional waivers required by the venue.
I release Skyline Pickleball from any liability related to the condition, operation, or policies of third-party venues.
8. Media Release
I grant Skyline Pickleball the right to capture and use my image, likeness, voice, and participation in photos, videos, or other media for promotional, marketing, and content purposes, without compensation.
9. Communication and Email Sharing
I agree that my contact information, including my email address, may be shared with other participants for league-based activities only, such as match coordination, scheduling, and playoffs.
I understand that this sharing applies specifically to structured league play and does not extend to unrelated events or programming.
My information will not be sold or used for unrelated marketing purposes.
10. Indemnification
I agree to indemnify and hold harmless Skyline Pickleball from any claims, damages, or expenses arising from my actions or participation in the Activities.
11. Governing Law and Legal Terms
This agreement shall be governed by the laws of the State of California.
I expressly waive all rights under California Civil Code Section 1542, which provides that a general release does not extend to claims that the releasing party does not know or suspect to exist at the time of executing the release.
If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full effect.
12. Acknowledgment of Understanding
I have read this waiver in full and understand that I am giving up substantial legal rights, including the right to sue.
I acknowledge that I am agreeing to this freely and voluntarily.
